These Terms and Conditions ("Terms") govern your access to and use of the website TiresStorage.com (the "Site") and the tire storage, pickup, and delivery services offered (collectively, the "Service"). Please read these Terms carefully. By creating an account or using our Service, you agree to be bound by these Terms.
"We," "Us," "Our" refers to TiresStorage.com.
"You," "User," "Customer" refers to the individual or entity using our Service.
"Service" refers to all services provided by us, including tire pickup, storage, and delivery, as scheduled through our Site.
"Tires" refers to the customer-owned tires and wheels that are provided to us for storage.
TiresStorage.com provides a seasonal tire storage service. We pick up your tires from a location you designate, store them in a secure facility, and deliver them back to you upon your request through our online platform.
To use our Service, you must register for an account. You agree to:
You are solely responsible for all activity that occurs under your account.
Payment Processing: All payments for our Service are processed through our third-party payment processor, Stripe. We do not collect, store, or have access to your full credit card or debit card information. By providing your payment information, you agree to be bound by Stripe's Services Agreement, available on their website.
Fees: You agree to pay all applicable fees for the Service as described on our Site at the time of your purchase.
Recurring Billing: If you subscribe to a recurring storage plan, you authorize us to charge your payment method on a recurring basis (e.g., monthly, annually) until you cancel your subscription through your account portal.
No Refunds: All payments are final and non-refundable, except at our sole discretion.
Ownership: You warrant that you are the legal owner of the Tires you entrust to us for storage.
Condition: You are responsible for the condition of your Tires prior to pickup. We are not responsible for pre-existing damage, wear and tear, dry rot, or cosmetic blemishes. We recommend you photograph your Tires before we collect them.
Scheduling: You are responsible for being present at the agreed-upon location and time for scheduled pickups and deliveries. A failure to be present may result in a rescheduling fee, as determined by us.
Storage: We will store your Tires in a secure, climate-controlled facility using commercially reasonable care.
Liability for Damage: Our liability for any damage to your Tires that occurs during storage, pickup, or delivery is strictly limited. In the event of proven damage caused by our direct negligence, our total liability shall be limited to the lesser of (a) the fair market value of a comparable used tire of the same make, model, and condition, or (b) $50.00 per tire. We are not liable for damage resulting from acts of God, unforeseen circumstances, or causes beyond our reasonable control.
Abandonment: If your account becomes delinquent and payment is not received within ninety (90) days of the due date, your Tires will be considered abandoned. We will make reasonable attempts to contact you using the email address on file. If we do not receive payment or a response within this 90-day period, we reserve the right to take full possession of the abandoned Tires and may, at our sole discretion, sell, recycle, or otherwise dispose of them to recover outstanding fees and costs, without any further liability or obligation to you.
You agree not to use the Service for any unlawful purpose or to violate any local, state, national, or international law. You may not interfere with the security or operation of the Site.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TIRESTORAGE.COM, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; OR (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO US IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
All operational communication, including scheduling, billing, and account management, must be conducted through your user account on our Site. TiresStorage.com does not offer customer support via email, telephone, or any other channel. The Service is provided as-is, without direct support.
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Colorado to resolve any legal matter arising from these Terms.
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this Site. You are advised to review these Terms periodically for any changes. Your continued use of the Service after the posting of changes constitutes your binding acceptance of such changes.
